Energy Industry EPC Contracts

This 3-day course is designed to introduce both lawyers and nonlawyers alike to the understanding of how to arrange and manage EPC contracts and how to avoid and manage disputes.

Course Instructors:

  • The course instructor is an Advocate, with Selborne Chambers, London, who has been admitted to practise as an Advocate before the Courts of Scotland since 1999. He became an Accredited Mediator in 2003.
  • The trainer is a mechanical engineer who has worked as a commercial Manager/Director in the onshore and offshore construction industry for the past 40 years. He worked for major oil companies in the UK, the Middle East and the Far East on a large number of offshore oil and gas projects.

Course Overview

The emphasis of the conference will be to provide a practical understanding of the contracting process including contract selection, tendering, negotiation, contract preparation, contract management together with a section on the effective management and resolution of disputes. Topics covered will include standard forms of contract, negotiation, contract management and dispute resolution. This course is aimed at those who are interested in acquiring a detailed understanding of how to negotiate EPC contracts, what the clauses are for and how you can best use them together with the knowledge of the legal environment which facilitates such a process. This course is delivered by combining a substantive legal understanding together with a practitioner's perspective.

The course is delivered using power point presentations, case studies and exercises. The course is an interactive mix of theory and practical from a practitioner’s perspective. The case study each day which covers preparation of the EPC enquiry document, negotiation and arbitration.The use of an EPC impacts upon such considerations as project structure, arranging financing and insurance, and the commercial agreements. The presentation on each topic will be followed by a discussion of sample terms and conditions.
