Course overview
An increasing number of energy industry projects are constructed under the terms and conditions of Engineering, Procurement and Construction Contracts (“EPC”). Typically, an EPC contract obligates the Contractor to complete construction by a certain date for a fixed price. In the context of the energy industry, EPC’s have proven to be particularly suited to the three main considerations in construction agreements: Scope, Schedule and Budget.

Scope – since the Contractor is responsible for all aspects of a project until acceptance of the facility by the Sponsor.

Schedule – the completion date is fixed and exceptions, the Contractor is accountable for delays and defective performance
-
Budget – the Contractor is at risk for cost overruns unless covered by force majeure or due to Sponsor approved variations.
The use of an EPC impacts upon such considerations as project structure, arranging financing and insurance, and the commercial agreements. The presentation on each topic will be followed by a discussion of sample terms and conditions.

Steven Walker
Steven P Walker is an Advocate, with Terra Firma Chambers, Edinburgh & Barrister with Tanfield Chambers, London, who has been admitted to practise as an Advocate before the Courts of Scotland since 1999. He became an Accredited Mediator in 2003. He was admitted to the Cayman Islands Bar in 2007 and to the English Bar as a Barrister in 2008.
Steven is a contentious commercial energy lawyer who practises Scots, English and International Law. His practice deals with all forms of commercial dispute, and he has a particular interest in Natural Resources, oil/gas/mining as well as energy and construction and engineering related disputes. He has regularly appeared before numerous arbitral tribunals in the UK and abroad. Steven is an Honorary Fellow of the University of Edinburgh and Honorary Lecturer and member of the Global Academic Faculty of the Centre for Energy, Petroleum, Mineral Law and Policy (CEPMLP). He speaks and lectures worldwide.
